Rental Policies & Terms of Stay
Welcome to Mischief Managed! We are delighted that you've chosen our home for your Oak Island vacation. Our goal is to provide every guest with an exceptional experience while maintaining the home to the highest standards for future visitors.
By confirming a reservation, the Primary Guest acknowledges that they have read, understood, and agreed to these Rental Policies and accepts responsibility for ensuring that all members of their party comply with them.
Reservation Requirements
The Primary Guest must:
- Be at least 25 years of age.
- Be present for the duration of the reservation.
- Provide a valid government-issued photo ID prior to check-in.
- Provide a valid credit card that will remain on file throughout the reservation.
Reservations made under false pretenses, by third parties, or on behalf of underage guests may be canceled without refund.
Maximum Occupancy
Maximum occupancy is 14 registered overnight guests.- 10 adults/4 kids
Only registered guests listed on the reservation may occupy the property unless prior written approval has been obtained.
Day visitors are welcome in reasonable numbers but may not create excessive noise, parking issues, or exceed local occupancy regulations.
Unauthorized guests may result in additional charges or immediate termination of the reservation.
Check-In & Check-Out
Check-In: 4:00 PM
Check-Out: 10:00 AM
Early check-in and late check-out may be available upon request but cannot be guaranteed. Unauthorized late departures may result in additional charges if they interfere with housekeeping or an incoming reservation.
Payment Policy
A reservation is confirmed upon receipt of the required deposit.
- A 50% deposit is due at the time of booking.
- The remaining balance is automatically charged 30 days before arrival.
- Reservations made within 30 days of arrival require payment in full at booking.
Failure to make payment when due may result in cancellation of the reservation.
Accepted payment methods will be listed during the booking process.
Security Deposit & Damage Authorization
A security deposit will be held until completion of reservation and returned after satisfactory turnover and damage assessment. Funds will be deducted for any of the following: Security Deposit can be sent via PayPal or Venmo to [email protected].
- Excessive cleaning
- Missing or damaged property
- Unauthorized pets
- Smoking remediation
- Policy violations
- Excess utility usage caused by negligence
- Costs associated with violations of these Terms
Guests will be provided documentation of any charges assessed after departure.
Cancellation Policy
Reservations canceled more than 30 days prior to arrival will receive a refund of all amounts paid less a $100 administrative cancellation fee.
Reservations canceled 30 days or fewer before arrival are non-refundable.
If the canceled dates are successfully rebooked, the Owner may, at their sole discretion, issue a partial refund less the administrative fee and any price difference associated with the replacement booking.
No refunds will be provided for:
- Late arrivals
- Early departures
- Illness
- Changes in travel plans
- Flight cancellations
- Weather
- Traffic
- Utility outages
- Beach conditions
- Government travel advisories
Because unforeseen events happen, we strongly recommend purchasing comprehensive travel insurance.
Hurricane, Weather & Mandatory Evacuations
The North Carolina coast occasionally experiences tropical storms and hurricanes.
No refunds will be issued due to weather or forecasts.
Should local or state officials issue a mandatory evacuation order, guests agree to vacate the property immediately.
Refunds related to mandatory evacuations will only be provided if required by applicable North Carolina law.
Travel insurance is highly recommended.
No Smoking or Vaping
Mischief Managed is a 100% smoke-free property.
Smoking, vaping, e-cigarettes, cigars, marijuana, pipes, or any similar products are prohibited anywhere inside the home or in enclosed outdoor areas.
Evidence of smoking may result in a minimum $500 cleaning and odor remediation fee, plus additional costs if necessary to restore the property.
Dog-Friendly Policy
We are proud to welcome dogs because vacations are even better with family—including the four-legged members.
The following policy applies:
- Maximum of 2 approved dogs
- Dogs must be disclosed during booking.
- A non-refundable pet fee applies for each approved dog.
- Dogs must be at least one year old.
- Dogs must be housebroken, healthy, vaccinated, and on veterinarian-approved flea and tick prevention.
- No cats or other animals are permitted without prior written approval.
Guests agree that dogs will:
- Not be allowed on beds or upholstered furniture.
- Not be left unattended for extended periods unless safely crated.
- Be cleaned up after immediately.
- Be kept under control and not disturb neighboring properties.
Guests are responsible for all pet-related damage and additional cleaning.
Failure to disclose pets before arrival may result in additional pet fees, cleaning charges, or immediate termination of the reservation without refund.
Pool & Hot Tub
The heated pool and hot tub are provided for guest enjoyment.
Use of these amenities is entirely at guests' own risk.
There is no lifeguard on duty.
Children must be supervised by a responsible adult at all times.
Guests agree to:
- No diving.
- No glass containers.
- No running or horseplay.
- No intoxicated use.
- Replace safety covers after use if applicable.
- No pets in pool.
The Owner is not responsible for accidents or injuries occurring from use of the pool or hot tub.
Pool heating may be available seasonally and may require an additional fee.
Mechanical failures or weather-related closures do not constitute grounds for refunds.
Beach Equipment
Beach chairs, toys, umbrellas, carts, and other equipment are provided as a courtesy.
Please rinse sand from equipment before returning it.
Guests are responsible for lost, stolen, or damaged items beyond normal wear and tear.
Parking
Parking is permitted only in designated parking areas on the property.
Parking on landscaping or neighboring property is prohibited.
Trailers, campers, RVs, boats, or oversized commercial vehicles require prior approval.
Guests are responsible for complying with all Town of Oak Island parking regulations.
Respect for Our Neighbors
Mischief Managed is located in a quiet residential neighborhood.
Quiet hours are observed from 10:00 PM until 8:00 AM.
The following are prohibited:
- Parties
- Weddings
- Large events
- DJ equipment
- Fireworks
- Illegal activity
- Excessive noise
Violation of neighborhood disturbance ordinances may result in immediate termination of the reservation without refund.
Housekeeping
Professional cleaning is included with every reservation.
Before departure, guests are asked to:
- Wash or start the dishwasher.
- Dispose of trash in outdoor containers.
- Place used towels in designated areas.
- Return furniture and beach equipment to their original locations.
- Lock all windows and doors.
- If possible start load of laundry.
Excessive cleaning required after departure may result in additional charges.
Maintenance
Please notify us immediately if anything is damaged or not functioning properly.
While every effort will be made to promptly address maintenance concerns, refunds will not be issued for temporary equipment failures, appliance malfunctions, internet interruptions, television service interruptions, utility outages, or circumstances beyond the Owner's control.
Owner's Right of Entry
The Owner or authorized maintenance personnel may enter the property when reasonably necessary for:
- Emergency situations
- Repairs
- Maintenance
- Safety concerns
- Inspection of reported damage
Whenever practical, reasonable notice will be provided.
Limitation of Liability
Guests understand that use of the home, balconies, stairs, decks, pool, hot tub, outdoor shower, grills, bicycles (if provided), beach equipment, and all other amenities is entirely at their own risk.
The Owner shall not be liable for:
- Personal injury
- Illness
- Theft
- Loss of personal property
- Accidents
- Acts of nature
- Utility interruptions
- Internet outages
- Construction occurring on neighboring properties
- Wildlife encounters
- Beach closures
- Circumstances beyond the Owner's reasonable control
Guests agree to indemnify and hold harmless the Owner from claims arising from the guests' use of the property except where prohibited by law.
Illegal Activity
Illegal activity of any kind is strictly prohibited.
This includes, but is not limited to:
- Illegal drug use
- Underage drinking
- Firearms discharged on the property
- Disorderly conduct
- Destruction of property
Violations may result in immediate eviction without refund and notification of law enforcement.
Lost & Found
The Owner is not responsible for personal items left behind.
Reasonable efforts will be made to locate and return lost items.
Shipping costs and handling fees are the responsibility of the guest.
Items not claimed within 30 days may be donated or discarded.
Force Majeure
The Owner shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to hurricanes, flooding, fires, government actions, pandemics, labor disputes, utility failures, internet outages, or other force majeure events.
Chargebacks
Guests agree to contact the Owner directly regarding any billing questions before initiating a credit card dispute or chargeback.
Improper chargebacks involving valid reservations or legitimate post-stay damage charges may be contested using booking records, signed rental agreements, communications, photographs, invoices, and other supporting documentation.
Governing Law
These Terms and Conditions shall be governed by the laws of the State of North Carolina.
Any legal action arising from a reservation or occupancy of the property shall be brought in the appropriate state or federal court located in North Carolina.
Accuracy of Information
Every effort is made to ensure that descriptions, photographs, amenities, and pricing are accurate.
From time to time, furnishings, décor, appliances, amenities, or equipment may be updated or replaced without notice.
The Owner reserves the right to correct typographical errors, pricing errors, omissions, or inaccuracies at any time.
Right to Refuse or Terminate Occupancy
The Owner reserves the right to refuse any reservation or terminate a stay without refund if guests:
- Exceed occupancy limits.
- Violate these policies.
- Damage the property.
- Disturb neighbors.
- Engage in illegal activity.
- Provide false booking information.
- Fail to comply with reasonable requests regarding safety or property management.
